Construction Litigation

One of Kelly M. Davis & Associates primary goals is to be one of the premier construction law firms in Texas.  Already, the Firm represents both general contractors, as well as most of the subcontracting trades and suppliers providing assistance in negotiating construction agreements and resolving payment problems or other disputes.

Kelly M. Davis has grown up around the construction industry and applies this experience in handling cases involving non-payment, design defects, changes, delays, bid mistakes and protests, foundation cases, breach of contract claims, Residential Construction Liability Act claims, and mediation.  In the past few years, we have been increasingly involved in defending clients in ADR disputes, as well as filing or defending claims under Texas’ Mechanic’s Lien Statutes.  Further, Kelly M. Davis gives seminars to local Builders, Contractors, Sub-Contractors and Suppliers to strengthen their knowledge of procedures available to collect payment for work and to protect their mechanic’s lien rights.

Kelly Davis also has a great deal of experience with the claims process of the Texas Residential Construction Commission on both the builder and homeowner’s side.

KMDA offers the drafting of complete construction contracts for Cost Plus Custom Homes, Fixed Price Custom Homes, and Spec Homes.
